Terms of Service

Agent Octane is a SaaS platform built for real estate agents. It provides tools for transaction management, AI-powered communication, document organization, lead tracking, voice AI, social content generation, and buyer/seller coordination. The Service is intended for licensed real estate professionals operating in the United States.

Agent Octane is offered on a monthly subscription basis. By subscribing:

• You authorize us to charge your payment method monthly at the rate for your selected plan.
• Subscriptions renew automatically unless cancelled.
• You may cancel at any time from your account settings. Cancellation takes effect at the end of your current billing period — you retain access until then.
• We do not offer refunds for partial months or unused features.
• We reserve the right to update pricing with at least 30 days' advance notice to your registered email.

Payments are processed securely by Stripe. We never store your full card number. All payment disputes should be directed to support@agentoctaneapp.com.

Your transaction data — including client names, property addresses, deal details, and documents — is your data. We store it securely to power the Service on your behalf.

• We do not sell your data to third parties. Ever.
• We do not share your clients' personal information with any external party without your explicit consent.
• Your data is used solely to deliver and improve the Service for you.
• We use industry-standard encryption in transit and at rest.
• You may request deletion of your data at any time by contacting support.

By using Agent Octane, you agree to:

• Provide accurate information when creating your account and transactions.
• Use the Service in compliance with all applicable laws, including real estate licensing requirements in your state.
• Maintain the confidentiality of your account credentials.
• Obtain any required consents from your clients before uploading their personal information to the Service.
• Not use the Service to engage in any unlawful, deceptive, or harmful activity.
• Not attempt to reverse engineer, scrape, or disrupt the Service or its infrastructure.

You are solely responsible for the accuracy of the data you enter, the content you generate using AI tools, and how you use or communicate that content with clients and third parties.

Agent Octane uses AI to generate social media posts, communications, and other content. This content is provided as a starting point and may not always be accurate, appropriate, or complete. You are responsible for reviewing, editing, and approving any AI-generated content before using it professionally or publicly.

We make no warranties regarding the accuracy or fitness of AI-generated content for any specific purpose.

The Agent Octane platform, including its design, code, branding, and AI models, is owned by Agent Octane, Inc. You are granted a limited, non-exclusive, non-transferable license to use the Service during your active subscription.

You retain full ownership of your data — your client information, transaction records, and uploaded documents. We claim no ownership over your content.

We aim to maintain high availability but cannot guarantee uninterrupted access. We may perform maintenance, updates, or experience downtime. We are not liable for any losses arising from Service unavailability.

We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice.

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or cause harm to other users or the platform. You may terminate your account at any time.

Upon termination, you may request an export of your data within 30 days. After that period, we may delete your data in accordance with our data retention policy.

To the maximum extent permitted by applicable law, Agent Octane, Inc. and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or business interruption — arising from your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, uninterrupted, or suitable for your specific needs.

These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction in those courts.

We may update these Terms from time to time. When we do, we'll update the effective date at the top of this page and notify you by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
